Intellectual Property
The Andalas Law Journal is committed to respecting and upholding intellectual property rights in all aspects of the publication process. This includes addressing plagiarism, copyright infringement, and using copyrighted materials appropriately. Our policy aligns with the guidelines provided by the Committee on Publication Ethics (COPE). For more information, please refer to COPE’s resources.
Plagiarism
Plagiarism is a serious violation of academic integrity and intellectual property rights. The Andalas Law Journal defines plagiarism as using another person's ideas, words, or work without proper attribution. This includes:
- Direct Plagiarism: Copying text verbatim from another source without quotation marks or appropriate citation.
- Self-Plagiarism: Reusing significant portions of one’s previously published work without acknowledging that it has been published elsewhere.
- Mosaic Plagiarism: Paraphrasing another’s work without proper citation, presenting it as one’s own.
- Inaccurate Citation: Failing to properly cite sources or providing incorrect information about the sources.
Plagiarism Detection
The Andalas Law Journal uses Turnitin as the plagiarism detection software to screen all submitted manuscripts for potential plagiarism. Authors are also encouraged to conduct their plagiarism checks before submission to ensure the originality of their work.
- Initial Screening: All manuscripts undergo an initial screening for plagiarism. If plagiarism is detected, the editorial team will evaluate the extent and severity of the issue. The maximum allowable similarity is 25%.
- Action on Plagiarism: Authors may be asked to revise their manuscript to address the issue if minor plagiarism is identified. In cases of significant plagiarism, the manuscript may be rejected, and the authors’ institutions may be notified.
Copyright and Licensing
Authors who submit manuscripts to the Andalas Law Journal must ensure that their work does not infringe on the copyright of others. This includes obtaining permission to use copyrighted materials such as figures, tables, and extensive text excerpts.
- Copyright Compliance: Authors are responsible for ensuring that all copyrighted materials used in their manuscripts are properly credited and that necessary permissions have been obtained.
- Creative Commons Licensing: All articles published in the Andalas Law Journal are licensed under a Creative Commons Attribution-NonCommercial-ShareAlike 4.0 International License. Authors retain the copyright of their work but grant the journal the right to distribute it under the terms of this license.
Handling Copyright Infringement
If the Andalas Law Journal is notified of potential copyright infringement in a published article, the editorial team will investigate the claim and take appropriate action.
- Investigation: The editorial team will review the claim and may request additional information or documentation from the parties involved.
- Outcome: If copyright infringement is confirmed, the journal will take corrective action, including issuing a correction, retraction, or removal of the infringing content. The authors’ institutions may also be notified.
Use of Third-Party Material
When using third-party material, authors must ensure that it is appropriately licensed for reuse and that they have obtained the necessary permissions to include it in their manuscript.
- Attribution: All third-party material must be properly attributed according to the terms of its license.
- Permission: If the material is not covered by a license that allows for reuse (e.g., Creative Commons), authors must obtain explicit permission from the copyright holder and provide documentation of this permission upon submission.
Transparency and Accountability
The Andalas Law Journal is committed to transparency and will address all intellectual property concerns promptly and thoroughly. We encourage authors, reviewers, and readers to report any concerns regarding intellectual property issues.
